AmCham and Ministry of Justice and Administration on digitalization of enforcement proceedings

Representatives of the American Chamber of Commerce in Croatia met with the representatives of Ministry of Justice and Administration to present AmCham's position paper on digitalization of enforcement proceedings.

The Ordinance on the forms in the enforcement procedure, the methods of communication by electronic means between the participants of the procedure and the allocation of cases to the notary public introduces obligatory communication by electronic means in enforcement procedures between notaries, courts, creditors and debtors, who are obligated to use electronic communication utilizing the state network system. The most important of the announced amendments, i.e. amendments intended to enable achieving the set goals, are the digitalization of the enforcement procedure, reducing the cost of the procedure and introducing courts into the enforcement system.

AmCham's position paper „Recommendations for the digitalization of enforcement proceedings“ contains a number of additional proposals for even more successful technical and practical implementation of the electrification of enforcement proceedings, so that it results in a long-term sustainable and efficient system.

Representatives of the Ministry of Justice and Administration welcomed AmCham's proposals and stressed out that some of the proposed recommendations have been either already implemented or in line with the Ministry’s views on the subject and called for further cooperation on proposing the best solutions for the digitization of enforcement proceedings.

Representatives from Ministry of Justice and Administration included Mirela Fučkar, Director of the Directorate for Civil, Commercial and Administrative Law; Mihovil Tvrtko Lonjak, Head of the Sector for Civil and Commercial Law Regulations and Iva Kuna, Senior administrative Advisor. AmCham representatives present at the meeting were Andrea Doko Jelušić, Executive Director, members of AmCham Judicial Committee: Marko Porobija (Law Office Porobija & Špoljarić), Barbara Cerinski and Tajana Horvat (EOS Matrix) as well as Svjetlana Momčilović, AmCham Policy Manager.
