2026 Policy Issues
1. Criminal Liability of AI
- Changes to Croatia’s Criminal Code in 2025 introduced a new provision on criminal liability related to artificial intelligence. These rules rely on a very broad definition of AI, making it unclear how and when criminal law applies to AI systems. This uncertainty risks slowing innovation and creates challenges for organizations that develop or use AI as it makes it harder to safely and confidently use AI technologies in practice.
2. Vouchers for New Users of Broadband Fiber Networks
- Croatia lags behind the EU average in the use of high-speed broadband. This gap is especially visible in rural and less developed areas. Limited use of advanced broadband networks slows digital transformation and reduces opportunities for citizens and companies to fully participate in the digital economy, highlighting the need for targeted measures to encourage wider uptake of fiber connectivity.
3. Funding for “EU Broadband Wave 3”
- Fast and reliable internet is essential for modern life, but many rural areas in Croatia still lack access to optical broadband. Existing EU funding for broadband development has not been enough to cover all communities, leaving a large number of households uncovered. This gap deepens the digital divide between urban and rural areas as it limits business and education opportunities.
4. Law on Dealing with Illegal Constructed Buildings
- Ministry of Physical Planning, Construction and State Assets estimates that approximately 50% of all infrastructure in Croatia is illegally built. Lack of legal status prevents upgrades, investment, and access to EU funding and affects sectors such as telecommunications, energy, and utilities.
The Committee will monitor all legal changes during 2026 by the Ministry of Justice, Public Administration and Digital Transformation and other competent authorities and react as necessary.
Additional topics outside the Plan Committee agreed to monitor and work on are: AI, implementation of the EU Data Act and EU Digital Omnibus.
