1. National Classification of Activities (NKD) and starting a business
- When starting or changing a business in Croatia, companies must register their activities under the National Classification of Activities (NKD). In practice, this system is very rigid, with activities defined so narrowly that businesses often feel forced to register many activities in advance. Any later changes require additional administrative procedures, which takes time and reduces flexibility.
2. Systematization of court case backlogs
- Courts in Croatia face a large number of unresolved cases, which puts pressure on the judicial system and leads to long waiting times. At present, court cases are not consistently grouped by factors such as complexity, value, or urgency, making it difficult to identify where delays are most severe. Lack of systematization makes it harder to manage court resources efficiently and ensure that cases are resolved in a timely and fair manner..
Implementation of the FDI Screening Act
The Croatian Parliament has urgently amended the Foreign Investment Screening Act, which provides a prerequisite for the establishment of a system for screening foreign investments that may affect national security or public order in Croatia, and consequently in the European Union. Its adoption fulfils one of the criteria for Croatia's accession to the OECD and transposes the EU regulation into Croatian legislation.
The Act contains elements that could in practice represent an administrative burden and legal uncertainty, through retroactive application, a lengthy screening process, etc. Not all implementing acts necessary for the consistent application of the Act have yet been adopted. There is a risk that the procedural requirements could deter investors or slow down new projects. The Committee members will monitor the implementation of the Act and, if necessary, prepare a position in coordination with the Committee on Trade and Investment.
