AmCham Position Paper on the Reform of the National Classification of Activities
AmCham has published the position paper proposing a reduction in the administrative burden on businesses and a simpler company incorporation procedure.
The position paper highlights barriers arising from the requirement to specify business activities in detail upon incorporation and the use of the National Classification of Activities (NKD) beyond its statistical purpose.
AmCham proposes allowing a general description of a company’s area of business without requiring an exhaustive list of unregulated activities, and limiting the registration court’s review to legally relevant requirements for incorporation and regulated activities. It also recommends eliminating sanctions against companies for carrying out permitted unregulated activities that are not individually specified in the court register.
Furthermore, AmCham proposes removing NKD classification from the company incorporation procedure or clearly defining its exclusively statistical role, with classification based on actual business activities using data from the fiscalization system, e-invoices and other administrative sources.
The proposed reform would enable simpler and faster company incorporation, greater business flexibility and higher-quality statistical data, while retaining the specific requirements and necessary authorizations for regulated activities.
