Improvement of the Legal Protection System in Public Procurement

Public procurement in Croatia accounts for more than 16% of GDP, making it essential to ensure a transparent and efficient system for overseeing the use of public funds.

AmCham highlights key challenges – insufficient oversight of procurement procedures, weak transparency during contract execution, limited institutional capacities, and inconsistent practices among supervisory bodies.

Recommendations include strengthening the role of the Ministry of Economy, the State Attorney’s Office, and the High Administrative Court, establishing a specialized court chamber for public procurement, publishing detailed information on contract amendments, and enabling professional associations to file complaints. Furthermore, introducing binding opinions by the State Commission for the Supervision of Public Procurement Procedures (DKOM) is proposed to enhance legal certainty and predictability. These measures aim to increase transparency, efficiency, and trust in Croatia’s public procurement system.
