Proposals for the improvement of the implementation of the Public Procurement Act

The American Chamber of Commerce in Croatia (AmCham) actively monitors and contributes to the improvement of the public procurement system.

While the Public Procurement Act (ZJN 2016) introduced important changes—such as mandatory use of the most economically advantageous tender (MEAT) criteria, greater transparency, and efficiency—practice has revealed several challenges. AmCham highlights areas for improvement, including proper application of quality criteria alongside price, simplification of proof-of-non-criminal-record procedures, clearer rules on conflicts of interest and contract amendments, equal VAT treatment, and enhanced transparency and digitalization of processes. The goal is to ensure a fair, efficient, and predictable procurement system that delivers the best value for the economy and society.
