Recommendations for Fast-track Procedures for Small Claims
Small claims in Croatia (up to HRK 10,000 before municipal courts and HRK 50,000 before commercial courts) are regulated by the Civil Procedure Act and EU Regulation 861/2007.
Although the law provides for faster and simpler procedures, in practice cases are often delayed due to legislative ambiguities, overloaded courts, and misuse by parties. This undermines trust in the judiciary and discourages investment.
AmCham proposes improvements, including:
- establishing specialized court departments and greater involvement of court advisors,
- stricter deadlines and evidence rules, mandatory training for judges,
- introduction of e-communication and standardized forms,
- better KPI incentives for judges.
The goal is to make small claims resolution faster, more efficient, and fairer, thereby enhancing Croatia’s competitiveness, easing court workloads, and strengthening public trust in the judiciary.
