AmCham warns that the reporting obligation imposed on suppliers regarding the execution of framework agreements in healthcare is not aligned with the Public Procurement Act. Monitoring contract execution is a legal responsibility of contracting authorities, and shifting this duty to bidders creates significant technical, organizational, and financial burdens. This practice particularly affects small and medium-sized enterprises, reducing their competitiveness and limiting market access. AmCham recommends removing such obligations from procurement documentation to protect equal treatment, transparency, and efficiency in public procurement in healthcare.
