Performance of the contract in exceptional circumstances
This webinar explained us about possibilities of fulfilling contracts, modifying or terminating contracts in the event of exceptional circumstances when performance of the contract becomes excessively difficult for one of the parties to the contract. Also, it will be explained which circumstances are considered to be exceptional according to the case law i.e. whether epidemics, pandemics, earthquakes, sudden falls or price spikes, administrative measures by public authorities, or something else are considered to be exceptional circumstances. The participants were also be informed of domestic and foreign case law in similar cases.
At this webinar, furthermore, it was discussed whether the debtor in such cases can be completely released from the contract and when the obligation can be adjusted or even the contract terminated and what are the rights of each contracting party in such events.
