Ordinance on Simple Procurement
The American Chamber of Commerce in Croatia has published its position paper “Ordinance on Simple Procurement”, presenting proposals for improving the Croatian public procurement system.
Simple procurement, although limited to procedures below the legally prescribed monetary
thresholds, constitutes a significant part of Croatia’s public procurement system, accounting for more than 14% of its total value.
AmCham proposes the adoption of a dedicated ordinance that would introduce a unified framework and minimum standards for simple procurement procedures. Key recommendations include:
- mandatory publication of simplified procurement through the Electronic Public Procurement Classifieds (EOJN),
- standardization of procedures to reduce the risk of misuse – harmonized rules create predictability and legal certainty for all bidders,
- setting minimum deadlines for bid submission and enabling electronic submission,
- ensuring transparent access to submitted bids for all interested bidders.
Adopting the Ordinance would contribute to more transparent and efficient use of public funds, reduce the risk of misuse, and encourage greater participation of both domestic and foreign bidders. This would ensure predictability of procedures, strengthen competition, and enhance the competitiveness of the Croatian economy.
